REGULATIONS OF THE MAKEAR PROMOTION: Partner Salons - Makear ™ Nails by Makear "

 

§ 1 INITIAL PROVISIONS

  1.     The organizer of the Promotion under the name "Nails by Makear ™", hereinafter referred to as the Promotion, is: Makear SC in Wrocław, 51-503, ul. Krzysztof Kolumba 9B, NIP: 8952085396, REGON: 364783135, hereinafter referred to as the Organizer.
  2.     The salon which is qualified, under the conditions set out in these Regulations, to participate in the Promotion becomes the Organizer's Partner, hereinafter referred to as the Partner.
  3.     The sale of goods by the Organizer to the Partner, apart from the first purchase, takes place through Distributors, the Organizer's Representative or through the Organizer's online store. The list of Distributors who are in constant cooperation with the Organizer is available at the Organiser's office, ul. Krzysztof Kolumba 9B, 51-503 Wrocław, as well as on the official website of the Organizer www.makear.pl in the distributors tab.
  4.     The Regulations, together with attachments, hereinafter referred to as the Regulations, are the only binding basis for mutual rights and obligations between the Organizer and SAapplicants
    o becomes a Partner, as well as between the Organizer and Partners. The above Regulations and any changes do not apply only if the Organizer and the Partner have made individual decisions in writing under pain of nullity.
  5.     Both persons applying for the Partner status and each Partner are obliged to read the content of these Regulations and comply with its provisions.
  6.     Participation in the Promotion is voluntary and free.

§ 2 SUBJECT OF THE PROMOTION

  1.     The main assumption of the Promotion is establishing cooperation between the Organizer
    and entities that will acquire the Partner status.
  2.     Due to participation in the Promotion,   The Partner has the rights, obligations and benefits set out in these Regulations. The Organizer, as part of individual provisions, retains the right to grant individual Partners benefits not indicated in the Regulations, while such separate provisions do not entitle other Partners to any claims against the Organizer.
  3.     The cooperation is aimed at popularizing the Organizer's brand, with the aim ofincrease in sales of products or services by the Organizer

§ 3 OBTAINING PARTNER STATUS

  1.     A partner may become:

and)    physical people,

b)    legal persons,

c)     entities without legal personality, to which the Act grants legal capacity, which conduct business activities in the field of cosmetic services, in particular cosmetic services related to the protection, styling and care of nails.

  1.       A person applying for the Partner status is obliged to:

and)       Fill in the declaration constituting Appendix 1 to these Regulations;

b)      Having qualified personnel to provide related services
using the Organiser's product offer; Conducting business in a place that meets aesthetic and hygienic standards both in law and generally accepted social requirements.

  1.     The partner is obliged to fulfilltruthful declaration. The Partner is obliged to inform the Organizer of any changes to the information provided in the form under pain of denying the Partner the benefits of the Promotion.
  2.     Implementation of the provisions of point 2 of this paragraph is related to the submission of declarations by the Person applying for the Partner status regarding:

and)     Statements about getting acquainted with the Regulations of the Affiliate Promotion and its acceptance;

b)    Declarations of consent to the processing of the Partner's data by the Organizer and the Distributor, for purposes related to the Partner's participation in the Promotion;

c)     A declaration of consent to receive the Partner's contact details via the provided contact details,
in particular, the telephone number and e-mail address, commercial and marketing information sent by the Organizer and the Distributor.

  1.     Acquisition of the Partner status takes place when the Organizer sends a message confirming the achievement of this status by e-mail or by post.
  2.     The organizer reserves the right to refuse to grant Partnera for any reason.

§ 4 AVAILABLE PACKAGES

  1.     Silver Package - The condition for participation in this package is: placing the first order of products for PLN 1000 net without a discount, excluding equipment, accessories and tools, and monthly orders for a minimum of PLN 400 net.

In return, the Partner Salon receives from the Organizer:

  •       8% discount on products and all trainings,
  •       Gadget package,
  •       Access to a unique Facebook group,
  •       Color palettes,
  •       Access to special promotions dedicated exclusively to Partner Salons,
  •       Competitions for Promotion participants,
  •       T-shirt with logo,
  •       Makear ™ Partner Showroom Certificate

Possibility to convert the discount on products into the equivalent in products.

 

  1.     Gold Package - The condition for participation in this package is to place the first order of products for PLN 2,000 net without a discount, excluding equipment, accessories and tools, and monthly orders for a minimum of PLN 600 net.

In return, the Partner Salon receives from the Organizer:

  •       10% discount on products and all trainings,
  •       Gadget package,
  •       Access to a unique Facebook group,
  •       Color palettes,
  •       Access to special promotions dedicated exclusively to Partner Salons,
  •       Competitions for Promotion participants,
  •       T-shirt with logo,
  •       Makear ™ Partner Salon Certificate,
  •       Early access to news,
  •       Participation in events organized for Partner Salons
  •       A one-time voucher with a 20% discount for the purchase of equipmentbaits and tools (valid for 30 days from the date of first purchase)
  •       Interior design elements,

Possibility to convert the discount on products into the equivalent in products.

 

  1.     Platinum Package - The condition for participation in this package is to place the first order of products for PLN 3,000 net without a discount, excluding equipment, accessories and tools, and monthly orders for a minimum of PLN 1,000 net.

In return, the Partner Salon receives from the Organizer:

  •       12% discount on products and all trainings,
  •       Gadget Package,
  •       Access to unique content on Facebook,
  •       Color palettes,
  •       Access to special promotions dedicated exclusively to Partner Salons
  •       Competitions for Promotion participants,
  •       T-shirt with logo,
  •       Makea Partner Salon Certificater ™,
  •       Early access to news,
  •       Participation in events for Promotion participants,
  •       A one-time voucher with a 20% discount for the purchase of equipment and tools (valid for 30 days from the date of the first purchase),
  •       Pasting a site or an illuminated box,
  •       Interior design elements,
  •       Priority in booking products,
  •       Information on the website and Facebook about the Partner Salon and advertising support for the salon.

Possibility to convert the discount on products into the equivalent in products.

§ 5 DUTIES OF THE ORGANIZER

  1.     Due to the fulfillment of the conditions of § 3 point 2 of the Regulations, along with the award of the Partner status, the Organizer will attach to the First Order a marketing and promotional package with the following packages:
  •         Silver Package worth PLN 1000 for a net price of PLN 1, within 30 business days.
  •         Gold package worth PLN 1,500 for the price of PLN 1 net, within 30 business days.
  •         Platinum package worth PLN 2,000 for a net price of PLN 1, within 30 business days

and)     The Partner, at the time of purchasing any Makear brand products, with the exception of milling machines, lamps and chests, from an authorized Distributor, indicated in §1 point 3
with the indication of having the Partner status, you are entitled to a discount in the amount appropriate to the selected package.

b)    The Organizer, at the Partner's request, may provide the Partner with marketing and sales advice on Makear ™ products, provided that the Partner provides all the necessary information that will allow for such support.

c)     During the promotional campaigns of the Makear brand in social media, which will include information about partner stores, the organizer will disclose the Partner as an entity deserving the name of a Makar Partner.

d)    The Organizer will publish the Partner's data on the website www.makear.pl in the Partner salons tab as an entity that deserves the name of a Partner of the Makear brand wrawith an indication of the Partner's location.

e)    The organizer provides for the possibility of organizing information and educational meetings related to the Makear brand's product offer, to which the Partners will be invited.

f)      The organizer, in agreement with the Partner, provides for the possibility of organizing training courses to raise the qualifications of the Partner's staff.

g)     The organizer is obliged to inform the Partner about new products, promotions and organized events.

§ 6 RESPONSIBILITIES OF THE PARTNER

  1.       The partner is obliged to make monthly purchases of Makear brand products for the amount specified in the package he has decided on, after taking into account the discount granted, excluding the purchase of milling machines, lamps and cases.
  2.         The purchase referred to in point 1 of this paragraph should be made at the Distributor, Organizer's Representative or in the Organizer's online store , and documented with a VAT invoice.
  3.       In order to verify the fulfillment of the obligation referred to in point 1 of this paragraph, the Organizer may requestd the Partner to provide proof of purchase from an authorized Distributor, and the Partner is obliged, within 3 working days of receiving such notification, to provide the Organizer with proof of purchase of Makear ™ brand products   by presenting them at the Organizer's office: Krzysztof Kolumb, 51-503 Wrocław, or sending them via e-mail to the Organiser's address   salonypartnerskie@makear.pl in JPG or PDF format.
  4.       The Partner expresses readiness and willingness to participate in promoting the Makear ™ brand, in particular through activity in social media in terms of both Partnership and
    and Makear brand products by posting or sharing information about the Makear ™ brand at least once a month, as well as participation in information and training meetings  
    and educational services related to the Makear brand's product offer.
  5.       The partner undertakes to participate in promotional campaigns of the Makear brand,
    in particular regarding:

and)     organization of brand shows,

b)    organization of competitions,

c)     participation in acaciadiscount charts.

  1.       The Partner is obliged to place external and internal design elements identifying the Partner as a person having this status at the place of providing services using Makear ™ brand products, in particular by visual identification of items with the Makear brand logo.
  2.       The partner is obliged to have qualified personnel in the provision of services with the use of Makear brand products, and also expresses readiness to participate and help in organizing training courses increasing qualifications and knowledge about the Makear brand.
  3.       The Partner undertakes to participate in the Promotion for 12 months from the date of the Partner's accession to the Promotion.

§ 7 COMPLAINT

  1.       Any complaints regarding the course of the Promotion may be submitted by the participants of the Promotion in writing with detailed justification, by registered mail to the Organiser's address or via electronic means to the Organiser's address: salonypartnerskie@makear.pl , within 14 days from the occurrence of the circumstances justifying the complaint .
  2.       The complaint should contain: the name and surname of the Promotion Participant, correspondence address, description of the allegations underlying the complaint and the Promotion Participant's expectations regarding the method of repairing the damage.
  3.       Filed complaints will be considered no later than within 14 days from the date of receipt of the complaint. Interested parties will be informed about the way of considering the complaint by e-mail or by post.

§ 8 Withdrawal from the Promotion

  1.       The entity with the Partner status may withdraw from the Promotion at any time. He is obliged to inform the Organizer about this fact by e-mail (the declaration is available on the Organiser's website www.makear.pl in the partner salons tab, constituting Appendix 2 to these regulations)
  2.       The Organizer has the right to exclude the Partner from the Promotion if the Partner does not fulfill his obligations, in particular with § 6 point 1. The Organizer will immediately inform the Partner of this fact by e-mail.
  3.       The Partner undertakes to reimburse all costs incurred by the Organizer if he resigns from participationor will be excluded from the Promotion within 12 months from the date of the Partner's accession to the Promotion.
  4.       In the above case, the Organizer settles accounts with the Partner by issuing an invoice
    detailing the costs incurred, calculated from the date of joining to the date of resignation or exclusion.
  5.       The date of joining the Promotion shall be the date of signing the declaration of accession to the Promotion (completed Annex 1). The date of resignation shall be the date of submitting the declaration of resignation (completed Appendix 2) or the date of exclusion from the Promotion.
  6.       Each Partner has the right to resign from participation in the Promotion after 12 months from the date of joining the Promotion, without incurring additional costs by submitting a Statement (available on the Organiser's website www.makear.pl in the partner showrooms tab, constituting Annex 2 of these regulations) to the Organizer to the address:

§ 8 Package change

  1.       After being awarded the Partner's statute, the Partner Salon has the right to change the previously declared Package.
  2.       The change can only be made to a higher package. e.g. from the Silver package to the Gold package or
    from Gold packages to Platinum package.
  3.       The change can only be made after the Organizer's approval.
  4.       After changing the package, the partner is entitled to additional benefits corresponding to the selected package, subject to the marketing and promotional package described in § 1 point 1. In this case, the partner receives the marketing and promotional packages reduced by the marketing and promotional package already received from the Organizer.

 

§ 9 PERSONAL DATA OF PARTICIPANTS

  1.       The administrator of the Partners' personal data is the Organizer - Makear SC with its seat
    in Wrocław 51-503, ul. Krzysztof Kolumba 9B, NIP: 8952085396, REGON: 364783135.
  2.       The Organizer informs that the personal data indicated by the Promotion Participants will be stored in a manner that protects them from disclosure and processed in accordance with
    with the provisions of the Act of August 29, 1997 on the protection of personal data (Journal
    U. of 2002, No 101, item 926, as amended d.).
  3.       The Organizer reserves the right to process personal data of Promotion Participants for marketing, information and statistical purposes. All Participants have the right to access their personal data and correct them, as well as request the cessation of data processing.
  4.       The Promoter is not responsible for any incorrect data provided by the Participant.

§ 10 CHANGE OF THE REGULATIONS

  1.       The Organizer undertakes that in the event of changes to the Regulations, these changes will not violate the rights already acquired by the Participants.
  2.       In the event of changes in the Regulations, the Organizer will inform the Participants of this fact by e-mail and by placing relevant information on the website www.makear.pl in the partner salons tab.
  3.       The amended version of the Regulations shall apply from the day following the date of announcement of the change on the website.
  4.       The Partner, within 14 days from the date of placing the information on the Organiser's website or receiving it by e-mail, has the right tosay participation in the Promotion. The statement is on   Organizer's website www.makear.pl in the partner salons tab (constituting Appendix 2 of these regulations) should be submitted in writing to the address: ul. Krzysztof Kolumba 9B, 51-503 Wrocław or via e-mail to the Organiser's address salonypartnerskie@makear.pl   Failure to submit a statement   on termination of participation in the Promotion is treated as acceptance of the change in the regulations.

§11 FINAL PROVISIONS

  1.       These Regulations are available on the Organiser's website at www.makear.pl/salonypartnerskie/, as well as at the Organiser's office.
  2.       In the event of gross negligence or failure to comply with the regulations, the Organizer has the right to suspend the Partner's participation in the Promotion or terminate the cooperation with the Partner, resulting in the cancellation of all discounts and other benefits granted to the Partner
  3.       Any information about the Promotion, contained in any promotional materials
    and advertising, they are only auxiliary. The provisions are binding information
    ia of these Regulations.
  4.       In matters not covered by these Regulations, the relevant provisions shall apply.
  5.       The Promotion Regulations define the rules of participation in organizing the Promotion and contain the conditions of participation that the Participant accepts upon joining the Promotion
  6.       Promotion participants agree to comply with the provisions of these regulations.
  7.         Both the Promotion Participants and the Organizer will endeavor to resolve any disputes arising from the Promotion Regulations in an amicable manner.
